These Terms of Service ("Terms") govern your access to and use of the Izemium software, licensing services, and websites (collectively, the "Service"). By installing, activating, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all terms and conditions, you must not install or use the Service.
Izemium is low-level, kernel-adjacent security software. It includes components that operate close to the operating system kernel, such as eBPF-based enforcement, hardware binding through TPM and hardware fingerprinting, and encrypted network tunneling. Izemium Pro is a paid license that is activated per hardware ID and grants use of the licensed features on the bound device for the licensed term, including updates and activation for that term.
Because the software operates at a low level of the system, it may interact with kernel facilities, network configuration, and hardware security modules. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
Licenses are issued per hardware ID (a fingerprint derived from your device). You agree to: (a) provide accurate hardware and contact information; (b) keep your license file and activation credentials secure; and (c) not share, resell, or transfer licenses except as expressly permitted by us. You are solely responsible for all activity conducted under your license.
Izemium Pro is offered as an annual license at the price displayed at checkout (currently $299 per year, subject to change). Fees are billed in advance for the applicable term and are exclusive of taxes, which will be added at checkout where applicable. Where a license is offered on an auto-renewing basis, renewal charges apply at the end of each term unless canceled before the renewal date. See our Cancellation Policy for details.
All payments for Izemium are processed exclusively by Paddle (Paddle.com Market Ltd / Paddle.com Inc), which acts as merchant of record for the transaction. By providing a payment method, you authorize Paddle to charge applicable license fees, taxes, and other charges. Paddle may store your payment information securely for future transactions in accordance with its privacy policy and PCI-DSS compliance standards. Card and payment details are handled entirely by Paddle and never touch Izemium servers.
You are responsible for all fees associated with your license. All fees are exclusive of applicable taxes, levies, or duties unless otherwise indicated. You agree to pay any applicable taxes, including VAT, GST, sales tax, or similar governmental taxes, that may be imposed on your purchase. Refunds are governed by our Refund Policy. Paddle may offer additional consumer rights depending on your country of residence.
For more details, see our Cancellation Policy. Upon termination, we may delete or retain your data in accordance with our Privacy Policy.
Refund eligibility is determined by our Refund Policy. Generally, we offer refunds within 14 days of purchase under certain conditions. All refund requests must be submitted through our support channel at support@izemium.com. Approved refunds will be processed to the original payment method (or through Paddle's system) within 7-10 business days. We reserve the right to deny refund requests that violate our Refund Policy or applicable law.
All content, features, and functionality of the Service (including but not limited to all information, software, text, displays, images, design, selection, arrangement, and look-and-feel) are owned by Izemium, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms do not grant you any right, title, or interest in the Service or any content therein. You may not copy, modify, distribute, create derivative works of, publicly display or perform, republish, download, store, or transmit any part of the Service without our prior written consent.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You specifically agree not to:
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Izemium is low-level security software. Installation and use involve interaction with your operating system kernel, networking stack, and hardware security components. You acknowledge and agree that you install and use the Service entirely at your own risk. The vendor accepts no responsibility for any damage to your system, software, configuration, data, hardware, or network — including data loss, system instability, loss of connectivity, or device malfunction — caused by or arising from the installation, configuration, or use of the software. You are responsible for maintaining backups and taking appropriate precautions before installation.
WE DO NOT WARRANT THAT: (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; OR (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IZEMIUM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES), OR FOR ANY LOSS OF OR DAMAGE TO SYSTEMS, HARDWARE, OR NETWORKS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT IZEMIUM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL IZEMIUM'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID IZEMIUM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR, IF GREATER, ONE HUNDRED US DOLLARS (US $100.00).
You agree to defend, indemnify, and hold harmless Izemium, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including use of the Service on systems or networks you are not authorized to modify.
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of these claims. You may not settle any claim without our prior written consent.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the courts of competent jurisdiction, and you irrevocably submit to the jurisdiction of such courts.
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a notice on the Service prior to the change becoming effective. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the new terms, you must stop using the Service.
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of these Terms shall continue in full force and effect. The failure of Izemium to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
